As Senate CLARITY Act odds plunge to 30%, Bitcoin’s refusal to drop signals a stealth upside trap

Bitcoin has largely shrugged off the deteriorating outlook for the CLARITY Act, raising the possibility that traders have already priced another legislative failure into the market.

Data from CryptoSlate shows the largest cryptocurrency trading around $63,500 as of press time, above the roughly $61,900 level seen on June 5, when Galaxy Digital put the bill’s chances of passage this year at 60%.

Those odds have since fallen to 30% as the Senate runs out of time to advance the crypto market-structure bill before its Aug. 7 recess. Bitcoin, however, has not followed them lower.

Charles Schwab noted that this disconnect suggests the market may now be treating delay as the baseline rather than a fresh bearish catalyst, leaving passage capable of producing a more meaningful repricing in the opposite direction.

The brokerage described BTC’s current setup as “limited legislative downside with an embedded call option,” arguing that enactment could revive expectations for faster institutional adoption even as incremental setbacks in Washington increasingly fail to move the market.

Senate calendar leaves CLARITY little room for delay

CLARITY’s path through the Senate is narrowing as the chamber’s remaining floor time collides with a crowded list of Republican priorities.

Anne Kelley, a former deputy director of the SEC’s Office of Legislative and Intergovernmental Affairs, said Senate floor time has become the “most valuable commodity in Washington,” with the CLARITY Act competing against Russia sanctions, the SAVE Act, budget measures and other legislation for limited space on the calendar.

Senate procedure makes that squeeze particularly difficult to overcome.

Under Rule XXII, once the chamber invokes cloture on legislation, the measure becomes unfinished business “to the exclusion of all other business” until it is disposed of. Post-cloture consideration can consume as many as 30 hours unless senators agree to accelerate the process.

Kelley said advancing one major bill therefore comes at the expense of floor time for another. Even if Senate leaders moved immediately on CLARITY, the sequence of cloture votes, amendments and debate would make passage before recess difficult without unanimous-consent agreements to waive procedural time.

The calendar pressure compounds unresolved disputes over government ethics, consumer protections, illicit finance and stablecoin rewards, leaving lawmakers with little margin for another round of negotiations.

Bitcoin, however, has shown limited sensitivity to that deterioration.

Schwab’s multivariate analysis found changes in CLARITY passage odds accounted for an average 4.3% of Bitcoin’s daily price variation in a model that also included the Nasdaq 100, Treasury yields, oil, inflation breakevens, the dollar and crypto liquidations.

When Schwab excluded liquidations, which it characterized as amplifiers rather than fundamental price drivers, CLARITY’s contribution rose to 8%. Nasdaq-linked risk appetite accounted for 20.5%, while 60.2% of Bitcoin’s daily movement remained unexplained by the legislative and macro variables in the reduced model.

These findings indicate that BTC traders place little weight on incremental shifts in legislative probabilities until lawmakers approach a definitive outcome.

Still, the weak relationship makes it harder to argue that another delay would automatically produce a substantial Bitcoin selloff. The greater repricing risk may now sit on the upside if Senate leaders unexpectedly find the votes and floor time to get the bill through.

Passage could revive the institutional trade

The muted response to changing CLARITY odds does not necessarily mean actual passage would be equally uneventful.

Schwab draws a distinction between traders reacting to incremental political developments and institutions responding after a federal market-structure framework becomes law.

According to the firm, CLARITY Act passage would reduce regulatory uncertainty for financial firms considering broader digital-asset offerings, potentially creating a catalyst that daily changes in prediction-market odds have failed to capture.

The brokerage pointed to April as an example of how quickly an institutional narrative can strengthen.

In the early part of the month, Bitcoin climbed from about $66,000 to $82,000, or roughly 25%, as major financial institutions like Morgan Stanley expanded their spot crypto offerings.

Indeed, US spot Bitcoin exchange-traded funds drew $1.97 billion in net inflows this month, which is their strongest monthly total of 2026. BlackRock’s IBIT alone attracted roughly $2 billion, while Morgan Stanley’s MSBT added another channel for institutional demand.

This overlap does not establish that institutional launches or ETF flows caused the rally. Bitcoin was exposed to other market forces during the period, and Schwab’s own regression shows that most daily variation cannot be explained by the factors it tested.

Still, the episode provides the basis for Schwab’s argument that passage itself could have a different market effect from merely increasing the probability that Congress eventually acts.

Some institutional forecasts already attach considerable value to that possibility.

FM Intelligence puts Bitcoin between $135,000 and $200,000 over the next year in its bullish scenario, which it assigns a 25% probability and conditions partly on CLARITY becoming law before the November midterms. Its base case is substantially lower at $95,000 to $130,000.

Asset manager Grayscale has made a similar case, arguing that Bitcoin may already be approaching its bear-market low and that passage of the CLARITY Act this year could unlock a new wave of institutional demand across the crypto industry.

Those views highlight the distinction between a market that has largely absorbed months of legislative uncertainty and one that has yet to price the consequences of an enacted regulatory framework.

Another delay would prolong a political stalemate that has so far failed to trigger a comparable deterioration in Bitcoin. Passage, however, could change the calculus for traditional financial firms by providing greater regulatory certainty around expanding their digital-asset businesses.

That is the asymmetry Schwab sees as the Senate deadline approaches: investors have had weeks to adjust to worsening expectations, while the market has yet to test what an unexpected legislative breakthrough would mean for institutional participation.
